The Privacy Commissioner recently published updated guidelines outlining what information should and should not be collected by landlords when deciding whether someone will make a suitable tenant.
“While there are some types of information a landlord can always legitimately seek from prospective tenants, such as proof of identity or whether they have any criminal convictions, other information requests regarding a tenant’s nationality, marital status, gender or banking history are almost never justified” – Privacy Commissioner.
The Guidance Fact Sheet and the full Guidelines can be found here and are intended for both landlords and tenants.
Please feel free to contact us if you have any questions about the updated guidelines.
